Saftey has always been our primary concern at N.S.A. Alpine activities involve certain risks, as a client you must take full responsibility for your own actions and participation.

Through our procedures we can greatly reduce the potential for accidents but cannot completely eliminate all hazards. For catskiing you will be required to sign an acknowledgment of risk- release of liability waiver prior to all tours.

Terms of Agreement (Applies to Catskiing only)

Terms of Agreement Must be read and signed by hirer.

This is a agreement of terms between client and Niseko Snowcat Adventures.

  1. In all cases safety will overrule. NSA guide decisions will be final on all factors .(Anyone who doesn't follow guides directions may be required to resort to foot transportation!!).
  2. You have made your NSA guide aware of any health issues you may have.
  3. Anyone impaired by alcohol, drugs, fatigue or medication will not be accepted on any tour. If at any stage after a tour has started you show signs of such, your tour with NSA is over, you will be transported back to trailhead and you will have to wait for that tour to finish before being transferred to your accommodation, in this case there will be no refund.
  4. In the case of snowcat breakdown or malfunction, a portion of tour left minus rental fee will be refunded.
  5. Good manners and "outdoor etiquette" are appreciated.
  6. NSA will not be held responsible for loss or damage of any property left in, on ,or carried by snowcat. Guides will help and take all care but take no responsibility.
  7. Due to the inherent nature of winter weather, all tours will proceed on cold, snowy days.
  8. In some cases hazardous weather conditions or safety factors may require NSA to cancel your tour, in such a case all payments will be fully refunded.
  9. Any action by client deemed dangerous or neglectful by guides will result in your immediate expulsion from tour, in this case no refunds will be given.
  10. NSA Strongly recommend confirmation of personal travel insurance to guard against unforeseen mishaps.
  11. A photocopy of passport or license will need to be presented.

ACKNOWLEDGMENT OF RISK RELEASE OF LIABILITY WAIVER WARNING:

By signing this document you give up your legal rights.

Read carefully before signing

TO: Niseko Snowcat Adventures., its agents, sales agents, affiliates, and representatives.

I, _______________________________________, waive and release any and all claims for damages, including claims for negligence, for myself, my heirs and other representatives and assigns which I may have as a consequence of my tour. In particular, but without restricting the generality of the foregoing, I hereby release from liability and agree not to sue Niseko Snowcat Adventures., its agents, officers, directors, employees, independent contractors, guides and representatives.

I,________________________________________, am aware that Snowcat touring exposes me to many risk, hazards and dangers (both known and unknown). I accept all risks, hazards and dangers to which I may be exposed and acknowledge the possibility that I may suffer loss resulting there from. I further acknowledge that such personal injury, death, illness, property damage or property loss may result from the risks inherent in Catskiing and related activities or may result from the negligence or faults of Niseko Snowcat Adventures., its agents, officers, directors, employees, independent contractors, guides and representatives. I am freely and voluntarily assuming all of the risks and hazards, and I am participating in the Snowcat tour as provided by Niseko Snowcat Adventures entirely at my own risk.

I further agree to act responsibly and prudent in the above mentioned activities which includes using common sense, follow and obey the guides and guide instructions, do regular check up and inspections of vehicle and/or other equipment material provided, as to prevent any mishap or accident. I agree to not use any equipment or participate in any tour under influence of alcohol, drugs or medication, and cause no wilful damage. I am aware I do not have to ride in terrain or conditions I am not comfortable with and will alert my guides of such. I have no known medical conditions that could effect my capabilities of Catskiing. Please list all allergies, medication and or medical conditions that could affect your ability to participate in your trip/rental. You are required to inform your guide/rental station staff prior to trip departure of any changes in your medical conditions:

In entering into this agreement I am not relying on any oral, written or visual representations or statements made by Niseko Snowcat Adventures. or anyone else to induce me to participate in a tour offered by Niseko Snowcat Adventures. This agreement shall be governed by and interpreted in accordance with the laws of Japan. I agree and comply with all the terms and conditions of the rental contract and tour registration form. I have read and fully understand the contents of this agreement prior to signing it, I am signing it freely and voluntarily and I agree that this agreement will be binding on me, my heirs, executors, administrators, personal representatives and assigns. damage and parts. I have taken notice of the tour terms and conditions.
